Privacy Policy

1. General provisions

This Privacy Policy is compiled in accordance with the requirements of the Law of the Republic of Kazakhstan dated May 21, 2013, No. 94-V "On Personal Data and Its Protection" (hereinafter referred to as the Personal Data Law) and defines the procedure for the processing of personal data and measures to ensure the security of personal data undertaken by RSoftware (hereinafter referred to as the Operator).

1.1. The Operator sets as its most important objective and condition for conducting its activities the compliance with the rights and freedoms of individuals and citizens when processing their personal data, including the protection of rights to privacy, personal and family secrets.

1.2. This Privacy Policy of the Operator regarding the processing of personal data (hereinafter referred to as the Policy) applies to all information that the Operator may obtain about visitors to the website https://rsoftware.kz.

2. Basic concepts used in the policy

2.1. Automated processing of personal data — the processing of personal data using computer equipment.

2.2. Blocking of personal data — the temporary cessation of processing personal data (except in cases where processing is necessary to clarify personal data).

2.3. Website — a collection of graphic and informational materials, as well as computer programs and databases that ensure their availability on the Internet at the network address https://rsoftware.kz.

2.4. Personal data information system — a collection of personal data contained in databases and ensuring their processing through information technologies and technical means.

2.5. Anonymization of personal data — actions resulting in the impossibility of determining the affiliation of personal data to a specific User or another subject of personal data without using additional information.

2.6. Processing of personal data — any action (operation) or a set of actions (operations) performed using automated means or without using such means with personal data, including collection, recording, systematization, accumulation, storage, clarification (updating, modification), extraction, use, transfer (distribution, provision, access), anonymization, blocking, deletion, destruction of personal data.

2.7. Operator — a state body, municipal body, legal or physical person, independently or jointly with other persons organizing and/or performing the processing of personal data, as well as determining the purposes of processing personal data, the composition of personal data subject to processing, actions (operations) performed with personal data.

2.8. Personal data — any information directly or indirectly related to a specific or identifiable User of the website https://rsoftware.kz.

2.9 User — any visitor to the website https://rsoftware.kz.

2.10. Provision of personal data — actions aimed at disclosing personal data to a specific person or a specific group of persons.

2.11. Distribution of personal data — any actions aimed at disclosing personal data to an indefinite circle of persons (transfer of personal data) or acquainting an unlimited circle of persons with personal data, including the publication of personal data in mass media, placement in information and telecommunication networks, or providing access to personal data by any other means.

2.12. Cross-border transfer of personal data — the transfer of personal data to the territory of a foreign state to an authority of a foreign state, a foreign physical or foreign legal person.

2.13. Destruction of personal data — any actions resulting in the irreversible destruction of personal data with the impossibility of further restoring the content of personal data in the personal data information system and/or resulting in the destruction of material carriers of personal data.

3. Main rights and obligations of the operator

3.1. The operator has the right to:
— Receive reliable information and/or documents containing personal data from the subject of personal data;
— In the event of the withdrawal of consent by the subject of personal data for the processing of personal data, as well as the submission of a request to cease processing personal data, the Operator is entitled to continue processing personal data without the consent of the subject of personal data if there are grounds specified in the Personal Data Law;
— Independently determine the composition and list of measures necessary and sufficient to ensure the fulfillment of obligations provided for by the Personal Data Law and normative legal acts adopted in accordance with it, unless otherwise provided by the Personal Data Law or other laws.

3.2. The operator shall be obliged to:
— Provide the subject of personal data with information concerning the processing of their personal data upon request;
— Organize the processing of personal data in the manner established by the current legislation of the Republic of Kazakhstan;
— Respond to appeals and requests from subjects of personal data and their legal representatives in accordance with the requirements of the Personal Data Law;
— Provide the authorized body for the protection of the rights of subjects of personal data with the necessary information within 10 days from the date of receipt of such a request;
— Publish or otherwise ensure unlimited access to this Privacy Policy regarding the processing of personal data;
— Take legal, organizational, and technical measures to protect personal data from unlawful or accidental access to them, destruction, alteration, blocking, copying, provision, distribution of personal data, as well as other unlawful actions concerning personal data;
— Cease the transfer (distribution, provision, access) of personal data, cease processing and destroy personal data in the manner and cases provided for by the Personal Data Law;
— Fulfill other obligations provided for by the Personal Data Law.

4. Main rights and obligations of subjects of personal data

4.1. Data subjects have the right to:
— Receive information concerning the processing of their personal data, except in cases provided by the laws of the Republic of Kazakhstan. The Operator provides the subject of personal data with information in an accessible form, which should not contain personal data related to other subjects of personal data, except when there are legal grounds for disclosing such personal data. The list of information and the procedure for obtaining it are established by the Personal Data Law;
— Require the Operator to clarify their personal data, block or destroy them if the personal data are incomplete, outdated, inaccurate, unlawfully obtained, or not necessary for the stated purpose of processing, as well as take measures provided by law to protect their rights;
— Impose a condition of prior consent when processing personal data for the purpose of promoting goods, works, and services in the market;
— Withdraw consent for the processing of personal data, as well as submit a request to cease the processing of personal data;
— Appeal to the authorized body for the protection of the rights of subjects of personal data or to the court against unlawful actions or inactions of the Operator in processing their personal data;
— Exercise other rights provided by the legislation of the Republic of Kazakhstan.

4.2. Data subjects shall be obliged to:
— Provide the Operator with reliable data about themselves;
— Inform the Operator about the clarification (updating, modification) of their personal data.

4.3. Persons who have provided the Operator with unreliable information about themselves or information about another subject of personal data without the latter’s consent are liable in accordance with the legislation of the Republic of Kazakhstan.

5. Principles of processing personal data

5.1. The processing of personal data is carried out on a lawful and fair basis.

5.2. The processing of personal data is limited to achieving specific, predetermined, and lawful purposes. The processing of personal data incompatible with the purposes of data collection is not permitted.

5.3. The consolidation of databases containing personal data processed for incompatible purposes is not permitted.

5.4. Only personal data that meet the purposes of their processing are subject to processing.

5.5. The content and volume of processed personal data correspond to the stated purposes of processing. The excess of processed personal data relative to the stated purposes of processing is not permitted.

5.6. When processing personal data, accuracy, sufficiency, and, where necessary, relevance of personal data to the purposes of processing are ensured. The Operator takes necessary measures and/or ensures their adoption to delete or clarify incomplete or inaccurate data.

5.7. The storage of personal data is carried out in a form that allows the identification of the subject of personal data no longer than required by the purposes of processing personal data, unless the retention period of personal data is established by the law of the Republic of Kazakhstan, a contract in which the subject of personal data is a party, beneficiary, or guarantor. Processed personal data are destroyed or anonymized upon achieving the purposes of processing or in the event of the loss of necessity to achieve these purposes, unless otherwise provided by the law of the Republic of Kazakhstan.

6. Purposes of processing personal data

6.1. The purpose of processing the User’s personal data is to inform the User by sending electronic letters. The Operator also has the right to send the User notifications about new products and services, special offers, and various events.

6.2. The User can always refuse to receive informational messages by sending the Operator a letter to the email address admin@rsoftware.kz marked "Refusal to receive notifications about new products and services and special offers".

6.3. Anonymized User data collected using internet statistics services are used to gather information about User actions on the site, improve the quality of the site and its content.

7. Conditions for processing personal data

7.1. The processing of personal data is carried out with the consent of the subject of personal data to the processing of their personal data.

7.2. The processing of personal data is necessary to achieve the purposes provided by the international treaty of the Republic of Kazakhstan or the law, to perform functions, powers, and obligations imposed on the operator by the legislation of the Republic of Kazakhstan.

7.3. The processing of personal data is necessary for the execution of a contract to which the subject of personal data is a party or beneficiary or guarantor, as well as for the conclusion of a contract initiated by the subject of personal data or a contract in which the subject of personal data is a beneficiary or guarantor.

7.4. The processing of personal data is necessary to exercise the rights and legitimate interests of the operator or third parties or to achieve socially significant goals, provided that in doing so, the rights and freedoms of the subject of personal data are not violated.

7.5. Processing is carried out of personal data to which unlimited access is granted by the subject of personal data or at their request (hereinafter referred to as publicly accessible personal data).

7.6. Processing is carried out of personal data subject to publication or mandatory disclosure in accordance with the law.

8. Procedure for collectign, storing, transferring and other types of processing personal data

The security of personal data processed by the Operator is ensured by implementing legal, organizational, and technical measures necessary to fully comply with the requirements of current legislation in the field of personal data protection.

8.1. The Operator ensures the security of personal data and takes all possible measures to exclude access to personal data by unauthorized persons.

8.2. Personal data of the User will never, under any circumstances, be transferred to third parties, except in cases related to the execution of current legislation or if the subject of personal data has given consent to the Operator to transfer data to a third party for the fulfillment of obligations under a civil law contract.

8.3. In case of identifying inaccuracies in personal data, the User can update them independently by sending a notification to the Operator at the email address admin@rsoftware.kz marked "Update of personal data".

8.4. The term of processing personal data is determined by achieving the purposes for which the personal data were collected, unless another term is provided for by the contract or current legislation.
The User can withdraw their consent to the processing of personal data at any time by sending a notification to the Operator via email to admin@rsoftware.kz marked "Withdrawal of consent to the processing of personal data".

8.5. All information collected by third-party services, including payment systems, communication tools, and other service providers, is stored and processed by these persons (Operators) in accordance with their User Agreement and Privacy Policy. The subject of personal data and/or with these documents. The Operator is not responsible for the actions of third parties, including the service providers mentioned in this clause.

8.6. Restrictions imposed by the subject of personal data on the transfer (except for providing access), as well as on the processing or conditions of processing (except for obtaining access) of personal data permitted for distribution, do not apply in cases of processing personal data in public, societal, and other public interests as defined by the legislation of the Republic of Kazakhstan.

8.7. The Operator ensures the confidentiality of personal data when processing personal data.

8.8. The Operator stores personal data in a form that allows the identification of the subject of personal data no longer than required by the purposes of processing personal data, unless the retention period of personal data is established by the law, a contract in which the subject of personal data is a party, beneficiary, or guarantor.

8.9. Conditions for terminating the processing of personal data may include achieving the purposes of processing personal data, the expiration of the validity period of the subject of personal data’s consent, withdrawal of consent by the subject of personal data, or a requirement to cease the processing of personal data, as well as the identification of unlawful processing of personal data.

9. List of actions performed by the operator with obtained personal data

9.1. The Operator performs the collection, recording, systematization, accumulation, storage, clarification (updating, modification), extraction, use, transfer (distribution, provision, access), anonymization, blocking, deletion, and destruction of personal data.

9.2. The Operator conducts automated processing of personal data with the receipt and/or transfer of the obtained information via information and telecommunication networks or without such networks.

10. Cross-border transfer of personal data

10.1. Before commencing cross-border transfer of personal data, the Operator must ensure that the foreign state to whose territory the transfer of personal data is intended provides reliable protection of the rights of subjects of personal data.

10.2. Cross-border transfer of personal data to foreign states that do not meet the above-mentioned requirements may only be carried out with the written consent of the subject of personal data for the cross-border transfer of their personal data and/or the execution of a contract in which the subject of personal data is a party.

11. Confidentiality of personal data

The Operator and other persons who have gained access to personal data are obliged not to disclose and not to distribute personal data to third parties without the consent of the subject of personal data, unless otherwise provided by law.

12. Final provisions

12.1. The User can obtain any clarifications on issues concerning the processing of their personal data by contacting the Operator via email at admin@rsoftware.kz.

12.2. Any changes to the Operator’s Privacy Policy regarding the processing of personal data will be reflected in this document. The Policy is effective indefinitely until it is replaced by a new version.

12.3. The current version of the Policy is freely available on the Internet at https://rsoftware.kz/privacy-policy.
